Terms of sale

ARTICLE 1 - PURPOSE These terms of sale govern the sale of photographic digital editions offered by Nico Garay (the "Seller") to individual or professional customers (the "Buyer") through photos.nicogaray.com. ARTICLE 2 - PRODUCTS The products sold are high-resolution digital files ("Digital Edition") representing original travel photographs created by the Seller. Each Digital Edition is sold with a personal use licence as defined in the Licence page of this website. ARTICLE 3 - PRICING All prices are displayed in euros including applicable taxes. The Seller reserves the right to change prices at any time; products are billed at the price in effect at the time the order is confirmed. ARTICLE 4 - ORDER AND PAYMENT Orders are confirmed only upon full payment. Payments are processed securely by Stripe, a third-party payment provider. The Seller does not store any payment card data. The Buyer warrants that they are authorised to use the chosen payment method. ARTICLE 5 - DELIVERY Delivery is digital and immediate: a download link is provided as soon as payment is confirmed. The link is valid for 48 hours and limited to 3 downloads. In the event of a technical issue, the Buyer may contact the Seller at contact@nicogaray.com to obtain a new link. ARTICLE 6 - RIGHT OF WITHDRAWAL Pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content whose supply has begun before the withdrawal period has expired and for which the consumer has expressly waived their right of withdrawal. By confirming the order and immediately accessing the digital file, the Buyer expressly waives their right of withdrawal. ARTICLE 7 - INTELLECTUAL PROPERTY The Buyer acquires only the rights of use defined in the Licence. Any unauthorised reproduction, distribution or commercial exploitation constitutes an infringement under applicable intellectual property law. ARTICLE 8 - LIABILITY The Seller shall not be liable for misuse of the digital file by the Buyer or for any indirect damages resulting from use of the product. The Seller's liability is limited to the order amount. ARTICLE 9 - PERSONAL DATA Personal data collected during the order (name, email) are used solely for order processing and file delivery. In accordance with the GDPR, the Buyer has the right to access, rectify and delete their data by contacting contact@nicogaray.com. ARTICLE 10 - GOVERNING LAW AND DISPUTES These terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the French courts shall have exclusive jurisdiction. Last updated: July 2025.
